What You Need To Know About Name Change After Marriage

Married Name Change Options

There are several options for assuming a new name once you’re married without having to apply for a legal name change.
• You can assume your spouse’s surname. While this is a common custom, it’s not a legal requirement that you acquire your spouse’s name on marriage

• One or both spouses can hyphenate their surnames. For example, if John Smith marries Ann Jones, Ann may choose to become Ann Smith-Jones. Both don’t have to have the same surname

• You may use both your maiden or married name depending on the circumstances. For example, you may choose to continue using your maiden name in professional situations and your married name in personal situations. If you choose this option, be aware that you must always book air tickets and travel arrangements in the name that appears on your passport.

• Continue using your maiden or current name. This option requires no further action to be taken.
If you would like a new name that’s not one of these options, you will need to apply for a legal name change through the Registry of Births, Deaths & Marriages in your state. If you would like more information on this option, please see our legal name change page.

How To Change My Name After Marriage

Once you’ve decided on your name change, you will need to have new identification issued and notify your new name to all of the entities / organisations and Companies you deal with on a day to day basis. This is where Next Step makes things easy. All you need is a copy of your marriage certificate and we simply send you a complete package of the forms and procedures to have your name changed in a matter of DAYS. If you don’t already have your marriage certificate, they can be ordered from the Registry of Births, Deaths & Marriages in the state where the event took place.

When Should I Change My Name?

You can assume your spouse’s name at any time after marriage. This isn’t a decision you need to rush in to within a certain time frame. However, Australian passports may only be changed to reflect a name change (due to marriage, cessation of a registered relationship or transitioning to a different gender) on a gratis basis if there is more than 2 years validity remaining and it is changed within 12 months of the registered event. What If I Married Overseas

Internationally issued marriage certificates are not accepted by all organisations as sufficient proof of your name change.  You will therefore require either an Australian issued marriage certificate or legal name change certificate to change your name.

If you get married in Australia, either before or after your foreign wedding, you will be issued with an Australian marriage certificate which can then be used to change your name as per the “Married Name Change Options” above. Ensure your flights and travel arrangements are booked in the name that appears on your current passport.

A marriage certificate is a legal document to verify your marriage registration and is used to establish a person’s identity.


 

You must apply for a certificate in the state in which your marriage was registered. IT DOES NOT NECESSARILY AUTOMATICALLY COME TO YOU. Check with your celebrant if it arranged.

Certifying Documents

Each state and territory have different legislation governing who can certify documents. To avoid confusion and potential delays, we recommend all copies of documents are certified by a Justice of the Peace.

Justice Of The Peace

Justice of the Peace (JPs) are voluntarily appointed officers who carry out a range of legally-related tasks to help the community. The most common task that JPs perform is certifying  copies  as being true and correct versions of the original document.

 

We have Queensland registered Justice of the Peace on staff. While they can certify copies of documents for residents of any Australian state or territory, it is at the discretion of each individual organisation as to whether or not they will accept copies certified by a Justice of the Peace outside of your state of residence. The original documents must be sighted with the copies in order for the copies to be certified. If you would like our staff to certify copies of your marriage, divorce or birth certificates or other relevant identification documents, please email us at admin@nextstep.com.au to arrange. You will need to send your original document along with the copies you would like certified and a postage paid reply envelope so we can return your documents to you. This is a free service. If your name or address change requires you to complete a Statutory Declaration or requires signatures to be witnessed, this will need to be conducted in person.
